Casual retail worker Joel had been regularly working 34-38 hours per week for 2 years. His hours were consistent and followed a very similar pattern of work week to week.
Employers must offer casual workers permanent employment after 12 months service if they:
- Have worked regular pattern of hours for at least the last 6 months on an ongoing basis
- Could continue to work your hours as a permanent employee without significant changes
Joel’s manager finally offered him a permanent contract but for just 12 hours per week.
12 hours per week didn’t reflect the pattern of hours he was working regularly.
Joel contacted the SDA for assistance because he didn’t think 12 hours per week were enough.
We recommended that Joel put his request in writing.
The SDA assisted him in writing up a request for a roster which would reflect his regular pattern of work.
After his written request was submitted, the Company offered Joel 23.5 hours per week.
The SDA believed he should be receiving more hours than that so we persisted and went back to the Company again.
Finally, the Company agreed that 30 hours could be accommodated.
Joel was then made a permanent employee working 30 hours per week.
